GEG Undertake End of Lease Condition Survey on Industrial Premises

GEG have been appointed by Faithful & Gould on behalf of their client South Derbyshire District Council (SDDC) to undertake a contamination survey of an industrial site prior to the end of the tenants' lease. If contamination is identified on the site's underlying strata or groundwater which can be attributed to the tenants' activities, under the polluter pays principle it would be the tenants responsibility to clean up the contamination under the Environmental Protection Act 1990 Part 2A, and not the landowner (SDDC).
